Acceptance of the Travel Terms & Conditions

Set forth below are the Terms and Conditions of Reservation issued by Sunergia Travel Group and applies to every client, and their guests, as set forth by Sunergia Travel Group. By completing any Reservation, You, the client, and yourr guests expressly agrees to be bound by and accepts these terms as stated below and as may be amended from time to time. Such modifications and amendments to have the same force and effect as those set forth below. Failure to accept The acceptance of the "Travel Terms & Conditions" in the time frame and manner determined by Sunergia Travel Group entitles Sunergia Travel Group to cancel Guest’s reservation without a refund.

Governing Law; Jurisdiction and Venue:

By completing any Reservation, You, the client, and your guests expressly agrees to be bound by and accepts these Travel Terms & Conditions Agreement shall be governed by and construed and enforced in accordance with the laws of the state of Ohio and to the jurisdiction and venue of any federal or state court located in or serving the City of Columbus, Ohio, County of Franklin, in the State of Ohio, in connection with any action or proceeding brought for enforcement of any obligations hereunder, and you the guest to hereby waive any and all personal or other rights under the law of any other country or state to object to jurisdiction within such locations for purposes of litigation to enforce such obligations. The guest irrevocably submit to such jurisdiction and venue, which jurisdiction and venue shall be exclusive and (b)waive any objection to such exclusive jurisdiction and venue or that such courts represent an inconvenient forum.

Changes and Modifications to Travel Terms & Conditions:

The Travel Terms & Conditions of the Sunergia Travel Group are subject to change at any time. Such modifications and changes shall have the full force and effect as a term and condition issued at the time of reservation or completion of registration as applicable.

Conflict Between the Travel Terms & Conditions by Sunergia Travel Group and our vendors:

Please note that all payment dates, reservation policies, cancellation policies, and reservation changes, set forth in the Sunergia Travel Group Travel Terms & Conditions at the time of purchase supersede those policies set forth in our vendors polices at our discretion and where allowed by local, state, or federal law.

Right to Modify or Cancel:

• Sunergia Travel Group may modify itineraries and schedules, change onboard entertainers and schedules, modify amenities, limit access to onboard venues, deny boarding, and/or delay or change departures or arrivals without any further obligation to Guest and any such change or modification, and doing so shall not be considered a Refund Event.
• Sunergia Travel Group reserves the right to cancel a reservation at any time at its sole discretion, and/or to deny or refuse service to any person, that does not adhere to safety, security, and appropriate guest conduct guidelines and doing so shall not be considered a Refund Event.
• Sunergia Travel Group reserves the right to cancel a reservation or event for any reason. Such cancellation shall be considered a Refund Event (see, Non-Refundable Payments – Refund Events).

Limitation of Liability:

• Terms and Conditions of Reservation Subject to Change: The Travel Terms & Conditions of your reservation from the Sunergia Travel Group are subject to change at any time.
• Not Responsible for Acts of Third Parties: The Sunergia Travel Group or its affiliates, parent companies, employees, shareholders, officers, and directors (collectively “The Sunergia Travel Group”) does not own the ship or properties or operate any entity that provides goods or services for your trip, including, for example, lodging facilities, transportation companies, local ground operators, guides, sightseeing companies, entertainment, food or drink service providers, equipment suppliers, etc. As a result, Guest agrees Sunergia Travel Group is not responsible for any negligent or willful act or failure to act of any person or entity, nor is Sunergia Travel Group is responsible for any negligent or willful act or failure to act of any person or entity it does not own or control, nor for any act or inaction of any other third party not under its control.
• Not Responsible for Guest Inability to Travel: Guest is responsible for arriving at the travel location in a timely basis and with all the documentation required for the reservation. he Sunergia Travel Group or its affiliates, parent companies, employees, shareholders, officers, and directors (collectively “The Sunergia Travel Group”) is not responsible for any loss, damages, costs, or expenses that Guest may incur for Guest’s inability to complete their reservation as outlined herein.
• Force Majeure: Further, he Sunergia Travel Group or its affiliates, parent companies, employees, shareholders, officers, and directors (collectively “The Sunergia Travel Group”) shall not be liable for, any loss or damage as a result of causes of any kind beyond the reasonable control of the Sunergia Travel Group or its affiliates, parent companies, employees, shareholders, officers, and directors (collectively “The Sunergia Travel Group”) (a “Force Majeure Event”), such as, but not limited to, strikes, lock-outs, stoppages of work or other labor difficulties, insurrection, riots, war, changes in laws and regulations and other acts or demands of civil, political or military authorities, freight embargoes, shipping restrictions, air travel delays or cancellations, car or truck shortages, inclement weather, accidents, fire, explosion, flood or unavoidable casualties, pandemics, epidemics, quarantine restrictions, etc.
• Limitation of Liability in the Event of a Refundable Cancellation: As stated above, you, the guest may elect to participate in the applicable Refund Program. Our obligation to the Guest is limited to the repayment of amounts heretofore paid for the reservation, Pass-Through Charges and any additional purchases made directly with the Sunergia Travel Group. All administrative Fees are non-Refundable. All Guest shall be liable for, any losses or damages incurred by Guest to any vedor properties and/or cruise ships, whether indirect, incidental, special, or consequential, including attorney fees, and not hold the Sunergia Travel Group or its affiliates, parent companies, employees, shareholders, officers, and directors (collectively “The Sunergia Travel Group”) responsible for their action while at properties and/or on a cruise ship.
